D.C. Lead Disclosure Law

Property Managers/Owners/Landlords: D.C.’s new Lead Disclosure Law is in effect, and the District Department of the Environment (DDOE) is currently enforcing. Each time you have turnover, you need to provide a special disclosure form for that particular unit before a new occupant can move in. In addition to having to disclose the presence of lead-based paint, you also have to disclose if there are any lead-based paint hazards and if there are any enforcement actions pending against you.

If a pregnant woman or a child under the age of six is about to move in, you must submit a clearance report that is less than one-year old proving that the particular rental unit contains no lead-based paint hazards.

EPA’s RRP Ruling

The Environmental Protection Agency (EPA)’s new Renovation, Repair and Painting (RRP) Rule went into effect on April 22. Every time you perform renovations in pre-1978 housing or in pre-1978 child-occupied facilities, you have to disclose lead paint information to the occupants, meet lead-safe work practice standards, provide cleaning verifications and keep records of your work for at least three years. You also need to have an employee who is an EPA Certified Renovator be a part of the job.

If you don’t comply, you could face fines of more than $37,500 PER DAY.
